                                                              PURCHASE AGREEMENT

(this is a legally binding contract - seek advice if you do not understand any portion herein)

THIS AGREEMENT, made this           day of             , 2004, by and between VON SHRADO GREAT DANES (BREEDER) and                                                                                          (PURCHASER) regarding the sale of the following dog:

TERMS OF SALE: The above-referenced dog is being sold to the purchaser(s) under the following terms and conditions. THE PURCHASE PRICES STATED BELOW ARE NON-REFUNDABLE (see below warranties for exceptions):

LIMITED REGISTRATION WITH COMPANION QUALITY GUARANTEE:    
  $800.00              This dog is being sold with an AKC LIMITED REGISTRATION. This means that the AKC can not register any progeny from this dog. This dog can not be shown in AKC conformation events, but can be shown in AKC non-conformation events (i.e. obedience, agility, tracking, etc.). This registration can be upgraded to a full AKC registration by the Breeder in the event the said dog proves to be worthy of producing get or being shown in conformation events. Breeder will process the upgrade upon the payment of $800.00    and an evaluation of the said dog. See below for companion quality guarantee.

FULL REGISTRATION WITH COMPANION QUALITY GUARANTEE:     
    $1200.00                         This dog is being sold with an AKC FULL REGISTRATION. This means that the dog may be bred and/or shown in all AKC events, if Purchaser desires to do so. See below for companion quality guarantee.

FULL REGISTRATION WITH SHOW/BREEDING QUALITY GUARANTEE:    $1600.00                         This dog is being sold with an AKC FULL REGISTRATION and Breeder will guarantee the dog against any show or breeding defects. See below for show/breeding quality guarantee.

WARRANTY APPLYING TO COMPANION QUALITY DOGS: The health of the above-referenced dog is warranted against genetic diseases which by determination of a competent veterinarian would lead to the premature euthanazia of said dog.  

WARRANTY APPLYING TO SHOW/BREEDING QUALITY DOGS ONLY: The above-referenced dog is warranted to be free of any disqualification faults as prescribed by the Great Dane Club of America breed standard, and is also warranted to be free of any genetic and/or breeding defects (i.e. hip dysplasia, bad bites, retained testicle, etc.).

EXCLUSIONS FROM WARRANTY: This warranty will be null and void in the following instances:                                                                                                                                                   
(1) For a period of two weeks following any immunization       
(2) If you board your dog in a public boarding facility prior to the age of six months.                        
(3) For any nutrition related diseases (i.e. OCD, HOD, panosteitis, etc.                                                   
(4) Bloat in dogs over eighteen months of age.                                                                                         
(5) If the recommended vaccine protocol supplied by the breeder is not followed.                                   
(6) Dogs 5 years of age and older.                                       

TERMS OF REPLACEMENT: In the event that euthanazia of the above-referenced dog is deemed to be in the best interest of the animal by a competent veterinarian because of the development of a disease not to include parvo virus, distemper virus, heartworms,  or any nutrition related disease as specified above in the warranty, said dog will be replaced by Breeder at no charge to Purchaser with a dog under the same terms and conditions as set forth herein, from either the same litter or from a subsequent breeding. All veterinarian costs associated herein shall be the sole responsibility of the Purchaser.  If the above dog is being sold under a show/ breeding warranty, and said dog develops either a breeding defect or a disqualification fault as indicated by the Great Dane standard, the Purchaser shall have the option of retaining ownership of the said dog and upon furnishing proof of spay/neuter of the said dog to Breeder.  Breeder shall (1) refund the sum of  $800.00 representing the difference in purchase price between a show/ breeding warranty and a companion quality warranty. (2) upon return of said dog, replace the dog with a dog under the same terms and conditions as the initial purchase at no additional cost to Purchaser.

PURCHASER(S) RESPONSIBILITY: Purchaser acknowledges herein responsibility for main-taining the said dog in a healthy, clean and safe environment for the dog's lifetime. Purchaser further acknowledges responsibility for any and all appropriate medical care that is necessary for maintaining the health and welfare of said dog.

PURCHASER agrees to never breed this Great Dane unless the DNA has been collected and sent to the AKC and agrees to furnish SELLER a copy of the DNA certificate.  If said dog is bred without  DNA Certification THIS CONTRACT IS NULL AND VOID AND SAID ANIMAL WILL BE RETURNED TO SELLER AT THE BUYERS EXPENSE AND THE PURCHASE PRICE WILL BE FORFEITED.                                       

The Breeder,  VON SHRADO GREAT DANES , will furnish information concerning the dangers of over vaccination,  the recommended protocol if choosing vaccines, recommended Nosode protocol if choosing Nosodes instead of vaccines and recommended feeding of all natural diets.

If Buyer choose not to feed an all natural diet, one of the recommended dog foods should be fed.   We cannot guarantee said dog if our protocol is not followed.  Receipts should be kept as proof.  

PLACEMENT OF THE DOG WITH THIRD PARTIES: UNDER NO CIRCUMSTANCES IS SAID DOG TO BE SOLD, GIVEN, PLACED, OR OTHERWISE TRANSFERRED TO ANY-ONE NOT A PARTY TO THIS CONTRACT WITHOUT THE EXPRESS PERMISSION OF THE BREEDER. In the event such a transfer occurs without the said permission of the breeder, and the Breeder determines that the dog has been placed in an unfit environment, PURCHASER SHALL BE HELD RESPONSIBLE FOR ANY ATTORNEY FEES, COURT COSTS AND OTHER EXPENSES (NOT LIMITED TO RESCUE AND BOARDING FEES) INCURRED BY BREEDER IN THE RECOVERY OF SAID DOG.

RETURN OF DOG TO BREEDER: If due to circumstances beyond the control of Purchaser,  said dog must be given up by Purchaser, then the Purchaser shall IMMEDIATELY return the said dog to Breeder. THERE WILL BE NO REFUND OF THE PURCHASE PRICE OF THE SAID DOG. In addition, the Purchaser SHALL return the dog's AKC registration papers signed over to Breeder, along with the dog's current health record AND funds in the amount of $100.00 payable to Breeder to cover Breeder's future veterinary and placement costs attributable to the said dog.

By signature hereto, Purchaser acknowledges receipt of a copy of this Purchaser Agreement, information package, including feeding information, vaccine schedule, and pedigree.

BUYER AGREES THAT THIS GREAT DANE WILL NOT BE HANDLED PROFESSIONALLY AT ANY AKC EVENT BY MR JOEL ROSENBLATT .  IF THIS PROFESSIONAL HANDLER is ALLOWED TO HANDLE THIS GREAT DANE THEN OUR CONTRACT IS NULL AND VOID AND SAID ANIMAL WILL BE RETURNED TO SELLER AT THE BUYERS EXPENSE AND THE PURCHASE PRICE WILL BE FORFEITED.                       

BUYER AGREES THAT THIS GREAT DANE WILL NOT BE BRED TO ANY COLOR OTHER THAN FAWN OR BRINDLE AND WILL NOT BE BRED TO ANY GREAT DANE FROM AQUILINE GREAT DANES OR WITH AQUILINE IN THE PEDIGREE.
